Our Firm’s Head of Litigation, Kyriakos Karatsis, successfully represented our clients in interlocutory proceedings for injunctions where the latter have been quashed by the President of D.C.Larnaca.

The President Judge of the District Court of Larnaca quashed an interim order issued ex-parte in a case based on an alleged trespass to a piece of land (on which the alleged trespassers/defendants operate one of the biggest play centres in Cyprus).

Given that the said play centre suffered serious damages and losses as a result of the Government measures taken to control the spread of Covid-19, it was in arrears towards the high rent of the premises. The Landlord terminated the tenancy agreement and sought free and vacant possession of the play centre. The Defendants did not deliver such possession and consequently the Claimants filed an action against them along with an interlocutory application for various prohibitory and mandatory injunctions which were issued ex-parte.

Following the contest of the injunctions application by the Defendants, who were represented by our Head of Litigation Mr. Kyriakos Karatsis, the Court cancelled the orders concluding that the Claimants were in breach of their duty of full and frank disclosure of all material facts of the case.
